1 — Interpretation and Definitions
1.1 Interpretation
The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
1.2 Definitions
- Account: a unique account created for You to access our Service or parts of our Service.
- Affiliate: an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares or voting securities.
- Application: the Blumi software program provided by the Company or Operator.
- Buyer: users of the Service who book appointments for services offered by Sellers.
- Country: refers to Singapore.
- Company: refers to Blumi (the Data Controller), referred to as “the Company”, “We”, “Us” or “Our”.
- Content: refers to content such as text, images, or other information that can be posted, uploaded, linked to or otherwise made available by You.
- Device: any device that can access the Service such as a computer, a cellphone or a tablet.
- Feedback: feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.
- Good: refers to the items or services offered for trade on the Service.
- Operator: refers to Blumi (the Data Controller).
- Order: a request by You to purchase or trade Goods through Us or from Sellers.
- Service: refers to the Application or Website or both.
- Third-party Social Media Service: any services or content (including data, information, products or services) provided by a third party that may be displayed, included or made available by the Service.
- Website: refers to Blumi, accessible from the URL where this Service is hosted.
- You: the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.

3 — Acknowledgment
These are the Terms of Service governing the use of this Service and the agreement that operates between You and the Company or Operator. These Terms set out the rights and obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service You agree to be bound by these Terms. If You disagree with any part of these Terms then You may not access the Service.
You represent that you are over the age of 18. The Company or Operator does not permit those under 18 to use the Service.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company or Operator. Please read Our Privacy Policy carefully before using Our Service.
4 — Governing Law
4.1 Singapore Law
The laws of the Country, excluding its conflict-of-law rules, shall govern these Terms and Your use of the Service. Your use of the Application may also be subject to other local, national or international laws.
4.2 Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
4.3 Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.
5 — User Accounts
5.1 Account Creation
When You create an account with Us, You must provide Us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person without appropriate authorisation, or a name that is otherwise offensive, vulgar or obscene.
5.2 Account Information
By creating an account, You agree to provide your name, email address, phone number, and address. We may request any other identification documents from time to time. As a Seller, You will be requested to provide bank details. As a Buyer, You agree to provide the necessary payment information for any Order requested via the Service.
5.3 Account Review
We do not perform background checks or endorse any users. We assume no responsibility for the accuracy or reliability of any information provided by users.
5.4 Account Password
You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password. You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorised use of Your account.
5.5 Account Termination
We may terminate or suspend Your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms. Upon termination, Your right to use the Service will cease immediately.
If You wish to terminate Your account, You may simply discontinue using the Service or contact us.
6 — Content
6.1 Your Right to Post Content
Our Service allows You to post Content. You are responsible for the Content that You post on or through the Service, including its legality, reliability, and appropriateness. By posting Content on or through the Service, You grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service.
You retain any and all of Your rights to any Content You submit, post or display on or through the Service and You are responsible for protecting those rights.
You represent and warrant that the Content is Yours (You own it) or You have the right to use it, and that the posting of Your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.
6.2 Content Restrictions
The Company or Operator is not responsible for the content of the Service's users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under Your account, whether done so by You or any third person using Your account.
You may not transmit any Content that is unlawful, offensive, threatening, libellous, defamatory, obscene or otherwise objectionable. We reserve the right (but not the obligation) to remove any Content from the Service.
6.3 Content Backups
Although regular backups of Content are performed, the Company or Operator does not guarantee there will be no loss or corruption of data. You agree to maintain a complete and accurate copy of any Content in a location independent of the Service.
6.4 Intellectual Property and Copyright Infringement
We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes a copyright or other intellectual property rights. If You believe in good faith that Content available on or through the Service infringes Your copyright, You may submit a notification to us by email at hey@blumi.co.uk.
7 — Orders of Goods
By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts.
7.1 Position of Service in Orders
The Company or Operator acts as a facilitator between Buyers and Sellers. We are, therefore, a third party in Orders, which limits Our liabilities.
7.2 Your Information as Buyer
If You wish to place an Order for Goods available on the Service, You may be asked to supply certain information including, without limitation, Your name, email, phone number, credit card number, expiration date of Your credit card, billing address, and shipping information. You represent and warrant that the payment methods are valid and that You have legal right to use them.
7.3 Availability, Errors, and Inaccuracies
We and the Sellers are constantly updating Goods on the Service. The Goods available may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information. We and Sellers cannot and do not guarantee the accuracy or completeness of any information.
7.4 Prices Policy
The Company and Sellers reserve the right to revise their prices at any time prior to accepting an Order. The prices quoted may be revised by Us subsequent to accepting an Order in the event of any occurrence affecting delivery caused by government action or any other matter beyond Our control. In that event, You will have the right to cancel Your Order.
7.5 Payments
Payment can be made through various payment methods we have available, such as Visa, MasterCard, Affinity Card or other online payment methods (PayPal, Stripe, GrabPay, etc.). Payment cards are subject to validation checks and authorisation by Your card issuer. The Company is not liable for any delay or non-delivery if such authorisation is denied.
7.6 Service Fees
The Company applies a service fee to use the Service. The price of the service fees is shown to You in the process of placing the Order. We reserve the right to change the service fees at any time.
7.7 Order Modification
Modifications can be agreed between You and the Sellers. By accepting modifications, You agree to bear any change in costs and conditions associated with such modifications.
7.8 Order Cancellation
7.8.1 Company Rights: We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to: Goods availability, errors in the description or prices for Goods, errors in Your Order, or fraud or unauthorised or illegal transaction is suspected.
7.8.2 Buyer Cancellation: If You as a Buyer cancel an Order, the amount You paid (including the Service fees) is not refunded. If unavoidable circumstances arise, please contact us to inform us of Your cancellation or to ask for a refund.
7.8.3 Seller Cancellation: If You as a Seller cancel an Order, the amount the Buyer paid (including the Service fees) will be refunded to the Buyer. If unavoidable circumstances arise, please contact us.
7.9 Order Dispute
By accepting these Terms, You and the involved parties accept that the Company or the Operator will resolve disputes at Our sole discretion when notified.
8 — Disclaimer of Warranties and Limitation of Liability
8.1 Limitation of Liability
To the maximum extent permitted by law, in no event shall the Company or Operator be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service).
The aggregate liability of the Company or Operator under any provision of these Terms shall be limited to the amount actually paid by You through the Service or 100 SGD if You haven't purchased anything through the Service.
8.2 “AS IS” and “AS AVAILABLE” Disclaimer
The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company or Operator expressly disclaims all warranties, whether express, implied, statutory or otherwise.
8.3 Links to Other Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by the Company or Operator. The Company or Operator has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
9 — Disputes Resolution
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company or Operator.
10 — Intellectual Property of the Service
The Service and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of the Company or Operator and its licensors. The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.
11 — Your Feedback to Us
You assign all rights, title and interest in any Feedback You provide the Company or Operator. If for any reason such assignment is ineffective, You agree to grant the Company or Operator a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.
12 — Changes to These Terms of Service
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms.
